In the 8th century, the juridical organisation for dispute and conflict resolution in the Lombard duchy of Benevento made use of different legal institutions: legal procedure, written law, the principle of aequitas, custom, transactions. The extant judicial documentation demonstrates that Lombard juridical organization was neither “primitive” nor “rudimentary”. On the contra- ry, it was very complex and presupposed the coexistence – within a single “state” – of multiple legal subsets, with distinct institutions and authorities in charge of enforcing them. Apart from reconstructing the judicial organization of the Lombard duchy, this inquiry aims at identifying the different judiciary offices, their internal structure, their competences in terms of subject matter and territory, and, lastly, their internal hierarchy.
