The decisive return of the entrepreneurial state. From the nationalisation of Alitalia to the extension of the so-called golden powers

This paper intends to investigate the inextricable link between some of the effects produced by the Covid-19 epidemic in the economic setting and the renewed role of the State in the economy, called to intervene, as indicated by the Constitution, to remove, or at least mitigate the inequalities resulting from economic and social situations, as well as to limit the obstacles to the full development of the human person.
The presence, even authoritative, of the State in the economic setting, consequent to a temporary framework of European competition law, has in fact legitimised some regulatory interventions aimed at fighting the emergency which includes the extension of the so-called golden powers to new economic sectors and the (re) nationalisation of Alitalia.
From the analysis of these measures, it will be possible to highlight how the State is called to carry out not only the role of entrepreneur but it must also cover the one of strategist in consideration of the necessary strategic analysis underlying all its actions.
