This article analyses the evolution of the maritime state property concessions regime, in light of EU legislation and in particular of the Directive 2006/123/EC and the most recent jurisprudence. The problematic inquiry of the incompatibility between individual and collective use of natural resources is raised. The need to guarantee a correct management of these resources is highlighted, in order to protect the fundamental rights related to them, as well as to avoid any form of exploitation or depletion, in particular safeguarding the environmental heritage and the social dimension arising from them.
