Abstract

When the topic of sexual identity crosses rights of the human person, inevitably the discussion focuses on the right to equality as guaranteed on constitutional level. The analysis of legal instruments - including the use of a normative language - reveals the gaps and contradictions of a trend that sometimes neglects the complexity of social phenomena and the depth of human nature.
