This work aims to examine the most recent developments in constitutional jurisprudence, regarding the relationship between the common judge, the Constitutional Court and the Court of Justice, when there is a contrast between a legal provision and a provision of the EU Charter of Fundamental Rights or of EU secondary law with direct effect, which pertains to the same rights protected also by internal parameters
