Abstract

The purpose of the contribution is to analyze the tools introduced by the Union, at the European Council on 23 April and the Eurogroup of 08 May 2020, functional to respond to the dramatic economic consequences deriving from the pandemic caused by the rapid spread of Covid -19, which the twenty-seven Member States will face. After a brief illustration of the different modalities put in place and the critical issues connected to them, we will try to demonstrate how they on the one hand strengthen the neoliberal order established in the Community system already since the Maastricht Treaty of 1992 (but entered into force on 01 November 1993), leading to a further upheaval of the State, an entity that is less and less exogenous to the commercial order and increasingly integrated into the global market, to the detriment of the model outlined by the current Republican Constitution and in the absence of changes formal pursuant to art. 138, on the other hand like these instruments, in the absence of a common fiscal policy still in the hands of the Member States, although strongly conditioned by the European economic governance after the sovereign debt crisis, end up widening the gap between the most indebted countries (such as the Italy) and those with a lower debt /PIL ratio (Federal Republic of Germany, Austria).
