Diritto al paesaggio. Un approccio multilivello

Abstract

the present paper aims to investigate the existence and consistency of a right to landscape. Therefore, by means of a multilevel perspective, this analysis focuses on the legislation concerning models of qualification, protection, conservation, planning and enhancement of landscape. It also examines the distribution of powers and competences as well as the different governance models in the landscape field. This is in order to evaluate their limits, potential and suitability when it comes to granting a fair balance between the needs of protecting the cultural identity of a territory and environmental and social-economic interests.
