Sovranità popolare v. sovranità parlamentare: il ruolo della comunità tra democrazia della rappresentanza e democrazia partecipativa

Abstract

The article, also in a European dimension , an alyzed in the light of the recent project “Renzi” of constitutional reform and of the referendum of 2011, the theme of the conflict between parliamentary sovereignty and popular so vereignty. In particular,the referendums of 2011, relating to the privatization of loc al public services, within which citizens have expressed, through a fundamental institution of participatory and direct democracy, a clear and net politic al will and the jurisprudence of the Constitutional Court ( judgment no . 199 of 2012 ) by which the Consulta, judging of legislative actions aimed at neutralizing the above will referendum, affirmed the principle of the bond referendum, giving in legal, new interest to the classincal theme of opposition between legislative sovereignty and sovereignty popular. In the interests of strengthening of the popular sovereignty moves the latest European law and in Italy the project “Renzi" of constitutional reform.
