Abstract

Article 7 of Legislative Decree n. 3 of 2017 provides that provision of the Italian Antitrust Authority has binding effect in the civil claim for damages. This rule has strengthened the relationship between the competitive institutions in a new way: Antitrust, administrative judge and ordinary judge. By reason of this novelty the norm has been at the center of a forceful debate on its constitutionality.
